These Terms of Service ("Terms") govern your use of the SubmitFox tax filing software service ("Service") operated by SubmitFox ("we", "us", "our").
By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree, please do not use our Service.
1. Service Description
SubmitFox is an HMRC-recognised tax filing software service that enables you to:
- Prepare and submit VAT returns under Making Tax Digital (MTD)
- Prepare and submit Self Assessment tax returns (SA100)
- Prepare and submit Corporation Tax returns (CT600)
- Store and manage your tax return data
- Receive AI-powered tax guidance through FoxChat
Note: SubmitFox is software that facilitates tax filing. We are not accountants, tax advisors, or financial advisors. For complex tax situations, we recommend consulting a qualified professional.
2. Eligibility
To use our Service, you must:
- Be at least 18 years old
- Be a UK taxpayer or authorised representative of a UK business
- Have authority to file tax returns for yourself or your organisation
- Provide accurate and truthful information
3. Account Registration
3.1 Account Creation
You must create an account to use our Service. You agree to:
- Provide accurate, current, and complete information
- Keep your password secure and confidential
- Not share your account with others
- Notify us immediately of any unauthorised access
3.2 HMRC Authorisation
To submit returns to HMRC, you must authorise SubmitFox to act on your behalf. This authorisation:
- Uses HMRC's secure OAuth 2.0 authentication
- Does not give us access to your Government Gateway password
- Can be revoked at any time through your HMRC online account
4. Pricing and Payment
4.1 Service Fees
Our current pricing is displayed on our website. Prices are in GBP and include VAT where applicable.
4.2 Payment
- Payment is required before submitting returns to HMRC
- We accept payment by credit/debit card via Stripe
- All payments are processed securely
4.3 Refund Policy
Fees are non-refundable once submission is attempted or completed.
- You pay to unlock submission to HMRC — this fee covers preparation and submission
- Once you click "Pay & Submit to HMRC", the submission process begins immediately
- If HMRC rejects a submission due to a verified software error on our part, we will resubmit at no additional cost or provide a refund at our discretion
- Before submission, if you experience technical issues preventing you from completing your return, contact us within 14 days of purchase
5. Your Responsibilities
Important: You are legally responsible for the accuracy of your tax returns. SubmitFox provides tools to help you prepare returns, but the legal responsibility remains with you.
5.1 Accuracy of Information
You are responsible for:
- Ensuring all information entered is accurate and complete
- Reviewing your return before submission
- Keeping records to support the figures in your returns
- Meeting HMRC deadlines
5.2 Tax Compliance
You must:
- Comply with all applicable UK tax laws and regulations
- Not use our Service for fraudulent or illegal purposes
- Report accurate income, expenses, and other tax-relevant information
5.3 Acceptable Use
You agree not to:
- Use our Service for any unlawful purpose
- Submit false or misleading information
- Attempt to gain unauthorised access to our systems
- Interfere with or disrupt our Service
- Copy, modify, or reverse engineer our software
- Use automated tools to access our Service without permission
6. Our Responsibilities
6.1 Service Availability
We will use reasonable efforts to:
- Keep our Service available and operational
- Maintain secure connections to HMRC
- Fix bugs and errors in a timely manner
- Provide customer support
6.2 Data Protection
We will:
- Protect your personal data in accordance with our Privacy Policy
- Use encryption for data in transit and at rest
- Never store your HMRC Government Gateway password
- Comply with UK GDPR and data protection laws

8. Intellectual Property
8.1 Our Property
SubmitFox, including our software, website, branding, and content, is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
8.2 Your Data
You retain ownership of the data you enter into our Service. You grant us a licence to process this data to provide our Service to you.
9. Limitation of Liability
Important Limitations
To the fullest extent permitted by law:
9.1 Service Limitations
- Our Service is provided "as is" without warranties of any kind
- We do not guarantee that our Service will be error-free or uninterrupted
- We are not responsible for HMRC systems, delays, or decisions
9.2 Liability Cap
Our total liability to you for any claims arising from your use of our Service is limited to the amount you paid us in the 12 months prior to the claim.
9.3 Exclusions
We are not liable for:
- Penalties, interest, or other charges imposed by HMRC due to errors in your returns
- Losses arising from your failure to meet tax deadlines
- Indirect, incidental, or consequential damages
- Loss of profits, data, or business opportunities
- Decisions made based on FoxChat guidance
9.4 Nothing Excluded
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be legally excluded
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:
- Your breach of these Terms
- Your violation of any law or regulation
- Inaccurate information you provide
- Your use of our Service
11. Termination
11.1 By You
You may close your account at any time through your account settings or by contacting us. Note that:
- No refunds are provided for unused services
- We may retain certain data as required by law
11.2 By Us
We may suspend or terminate your account if:
- You breach these Terms
- We suspect fraudulent or illegal activity
- Required by law or HMRC
- We discontinue our Service (with reasonable notice)
11.3 Effect of Termination
Upon termination:
- Your right to use our Service ends immediately
- You can request a copy of your data before termination
- We will retain data as required by law (e.g., 7 years for tax records)
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by:

Continued use of our Service after changes constitutes acceptance of the new Terms.
13. Dispute Resolution
13.1 Informal Resolution

13.2 Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.

14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SubmitFox.
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
14.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right.
14.4 Assignment
You may not assign your rights under these Terms. We may assign our rights to a successor or affiliate.
